Terms of service

These are drafts. They are written for an Australian strata and commercial services business and reflect how LevelSweep intends to operate, but they have not been reviewed by a lawyer. Have them checked before you publish or rely on them.

1. Who you are contracting with

LevelSweep is a trading name of NSW Cleaning & Gardening Corporation Pty Ltd, ABN 36 675 643 651 (we, us). We operate alongside StrataKeep, which provides building and facilities management. Where these terms refer to you, they mean the owners corporation, building management committee, community association or building owner named on the work order, not the individual who requested it.

2. Quotes and work orders

  1. A price generated on our website is an offer to perform the work described, valid for 60 days from the date issued.
  2. The price is calculated from the information you give us: the number of car spaces, the number and type of levels, the foyer area and the floor finish. If any of that is materially different on the day, clause 3 applies.
  3. Work is scheduled once you issue a work order, either by replying to the emailed work order or by sending your own referencing our quote number.
  4. Only a person authorised by the scheme may issue a work order. By issuing one you confirm you hold that authority.

3. If the building is not as described

  1. Small differences between the quoted and actual space count are absorbed. We do not re-invoice for a handful of bays.
  2. If the difference is material, meaning it moves the job into a different band on our published rate card, we will stop before starting, tell you, and provide a revised price. We will not perform work at the higher figure without your agreement.
  3. If we arrive and cannot access the site, or headroom or ramp gradient prevents our plant from entering, we will contact you before leaving. A failed attendance caused by access issues outside our control may be charged at 50% of the quoted visit.

4. What is included

  1. Car park sweeping. Machine sweeping of bays, aisles, ramps, driveway aprons and stairwell landings on the levels listed in the work order. Debris is removed from site.
  2. Foyer and lobby scrubbing. Machine scrubbing of the areas listed in the work order, with wash water recovered by the machine.
  3. Pressure washing. Washing of the areas listed in the work order, typically entry aprons, loading docks, bin room surrounds and oil stained bays. Run-off is controlled and directed to sewer or contained for removal, never to a stormwater drain.
  4. Photo record. A photographic record of each level or area serviced, provided on the day.
  5. Anything not listed on the work order is not included. That includes line marking, sump and pit cleaning, sealing or coating, and any wet work in fire isolated stairs, which we do not perform under any scope.

5. Occupied bays and obstructions

We sweep around vehicles, storage, bulk waste and any other obstruction present on the day. Obstructed areas are noted and photographed. We do not move vehicles or property, and we do not require the building to be emptied. On recurring services, previously obstructed areas are prioritised at the following visit.

6. Floors requiring inspection

Natural stone, terrazzo and timber are porous or coated surfaces that can be permanently damaged by the wrong pad or chemical. Where you select one of these finishes, any price shown is indicative only and does not become a quote until we have inspected the finish on site and confirmed the price in writing.

7. Fire stairs

We do not wash down fire stairs. Fire isolated stairs are a designated egress path, typically have no floor waste, and a wet tread creates a slip risk that sits with the owners corporation as well as with us. Where fire stairs are included in a work order, the service is dry: vacuum, damp mop, handrails and cobweb removal. Pressure washing is never performed in a fire isolated stair.

7A. Water and run-off

Where a work order includes pressure washing, run-off is contained and directed to sewer or recovered for removal. We do not discharge wash water, detergent or oil residue to a stormwater drain. Where a site has no sewer point or containment is not achievable, we will tell you before starting rather than proceed and create a pollution risk for the owners corporation.

7B. Completing in one visit

  • We schedule every job to be completed in a single attendance, and that is what we plan and price against.
  • Where something outside our control prevents completion on the day, we will tell you before we leave and agree a return at no additional charge. Examples include a level being inaccessible, a power or water point being unavailable, mechanical ventilation being off, or a safety issue arising on site.
  • “Finished the same day” describes how we schedule and staff the work. It is not a guarantee that every conceivable building can be completed in one attendance, and where we know in advance that a building cannot be, we will say so before you issue the work order rather than after.

8. Hours of work

We attend between 8am and 4pm on weekdays. We do not perform night work or weekend work as standard. Where a building genuinely cannot be completed within a single attendance, we will tell you before you issue the work order.

9. Safety on site

  1. Warning signage is placed at each active work area and removed on completion.
  2. Machine swept surfaces are dry. Machine scrubbed surfaces are trafficable within minutes but are signed until dry.
  3. You agree to advise us of site specific hazards, induction requirements, height restrictions and access arrangements before the first visit.

10. Recurring services and discounts

  1. Recurring work orders attract the discount shown on our published rate card at the time of quoting.
  2. There is no minimum term, no lock-in and no clawback. The discount applies while the service recurs. If you stop, the discount stops with it. We will not retrospectively charge back a discount already given.
  3. Either party may end a recurring arrangement with 30 days notice in writing. Work already performed remains payable.
  4. Each service is quoted and documented as its own work order. Where a building takes more than one service, the work orders remain separate so scope and invoicing stay clean.

11. Payment

  1. We invoice the scheme identified by the SP, BMC or DP number on the work order. We do not accept card payment for these services and no payment is required at the time of quoting.
  2. Invoices are issued on completion of the service and are payable within 14 days.
  3. All prices are ex GST unless expressly stated as inclusive. GST is applied at invoice.
  4. Overdue amounts may attract interest at a fixed rate of 10% per annum, calculated daily from the due date until paid.

12. Cancellation

Cancel or reschedule at no charge with more than 48 hours notice. Inside 48 hours, or where our crew has already mobilised to site, a cancellation fee of 50% of the visit may apply. We will always try to reschedule rather than charge.

13. Subcontracting

We may perform work through approved subcontractors. Where we do, we remain responsible to you for the work under these terms, and every subcontractor is required to hold current public liability insurance and to work to our method statements.

14. Insurance

Public liability insurance is held under the NSW Cleaning & Gardening Corporation Pty Ltd policy. A certificate of currency is available on request and is provided before the first attendance where the building requires it.

15. Damage and claims

  1. Report any damage you believe was caused by us within 7 days of the visit, with photographs.
  2. Pre-existing damage, including spalling, delamination, cracked topping, failed line marking and oil staining, is not caused by sweeping or scrubbing and is not our responsibility. Where we notice it, we photograph it and tell you.
  3. Our liability is limited, to the extent permitted by law, to re-performing the service or refunding the amount paid for it.

16. Australian Consumer Law, and what happens if you are not happy

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Our services come with guarantees that cannot be excluded, including that they will be provided with due care and skill and be fit for purpose.

If the work is not up to standard, tell us within 7 days of the service and send a photograph if you have one. Our remedy, at no charge to the scheme, is:

  1. We re-attend and rectify the affected area, usually within the following week.
  2. If the problem cannot reasonably be rectified by re-attending, we credit or refund the affected portion of the invoice.
  3. Where a failure is major within the meaning of the Australian Consumer Law, you may choose to cancel the service and obtain a refund of the amount paid for that visit, or keep the service and seek compensation for the difference in value.

Where our liability can be limited, it is limited as set out in clause 15.

17. Privacy

We handle personal information in accordance with our privacy policy, which explains what we collect, why, and how we may contact you about other services in our group.

18. Governing law

These terms are governed by the laws of New South Wales, and the parties submit to the non-exclusive jurisdiction of its courts.
