These are drafts. They are written for an Australian strata and commercial services business and reflect how LevelSweep intends to operate, but they have not been reviewed by a lawyer. Have them checked before you publish or rely on them.

1. What this is

These terms apply where you perform car park sweeping or floor scrubbing work for LevelSweep, a trading name of NSW Cleaning & Gardening Corporation Pty Ltd, ABN 36 675 643 651. You are an independent contractor running your own business. This is not employment and it is not a partnership.

Read this part properly. Calling an arrangement contracting does not make it so. If the substance of the relationship is employment, the law treats it as employment regardless of what either of us signed, and the consequences fall on us both. The table below is how we keep the substance right, and we expect it to stay true in practice.

2. What genuine contracting looks like here

PaymentYou invoice per job at agreed rates. You are not paid an hourly wage and you do not accrue leave.
RectificationYou bear the cost of correcting defective work, as any business does.

3. What you must hold

  1. A current ABN, and GST registration if your turnover requires it.
  2. Public liability insurance of not less than $20 million, with a certificate of currency provided before your first job and on each renewal.
  3. Workers compensation cover for anyone you employ, or a personal accident policy if you are a sole trader.
  4. Motor vehicle insurance for any vehicle used, and plant cover for your own machines.
  5. Licences and tickets appropriate to the plant you operate.

4. Safety

  1. You are a person conducting a business or undertaking in your own right and hold your own duties under the Work Health and Safety Act 2011 (NSW).
  2. You must provide a safe work method statement for the work and follow it.
  3. Warning signage must be placed at each active work area and removed on completion.
  4. Report any incident, near miss or property damage to us on the day it occurs.
  5. Confined space, working at heights and hot works are not within scope without prior written agreement.
  6. Where the work order includes pressure washing, a separate SWMS covering electrical safety, run-off containment and slip control is required before attendance.

5. Standard of work

  1. Complete the scope on the work order in a single attendance unless we agree otherwise in advance. Buildings are told the job takes one day and that commitment is passed to you.
  2. Attend within the site's permitted hours, which are ordinarily 8am to 4pm on weekdays.
  3. Provide a photographic record of each level or area on completion, including any area you could not reach and why.
  4. Leave no debris, no signage and no plant on site.
  5. Do not perform wet work in fire isolated stairs under any circumstances.
  6. Never discharge wash water or detergent to a stormwater drain.

6. Conduct on site

You represent LevelSweep while you are on a building. Do not solicit work directly from a building we introduced you to, do not discuss our pricing with residents or committee members, and refer all questions about scope or cost back to us. Complaints go to us, not to the strata manager.

7. Rates and payment

  1. Rates are agreed per job before you accept it, or by a rate schedule agreed in writing between us.
  2. Invoice on completion, referencing the work order number and attaching the photo record.
  3. We pay on 14 day terms from a correctly rendered invoice.
  4. Work performed without a work order is not payable.

8. Non-solicitation

For 12 months after your last job for us, do not directly solicit car park sweeping or floor scrubbing work from any building we introduced you to. This does not stop you working for a building that approaches you independently, and it does not restrict your business generally.

9. Ending the arrangement

Either of us may stop offering or accepting work at any time, with no notice required and nothing owing beyond work already performed. We may stand you down immediately for a safety breach, for working without a work order, or for conduct on a building that puts a client relationship at risk.
